Arbitration
With consistent approval from the higher courts over the past 60 years, Pakistani domestic arbitration law is now very well established. International arbitration has been codified since the New York Convention was ratified in 2006, which not only gives the arbitration process more certainty but also allows foreign investors to do business in a familiar arbitration jurisdiction. The piece also briefly discusses legislative changes affecting the legal framework for commercial arbitration and examines some of the important cases that have been covered in Pakistani law journals.
There are currently two main pieces of legislation dealing with arbitration in Pakistan: The Arbitration Act, 1940 and the Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act, 2011.
