Mediation
In accordance with mediation law, a process in which a neutral third party, the mediator, encourages and facilitates the resolution of a dispute between two or more parties. It is a non-binding, informal, and non-adversarial process with the objective of assisting the disputing parties in reaching a mutually acceptable and voluntary agreement. The mediator serves as a facilitator, helping the parties spot problems, work together to solve them, and consider creative settlement options. Despite being optional and non-binding, the procedure yields a startlingly high settlement rate. Because the parties created the remedy themselves, they are typically more satisfied with a mediated resolution than one that is imposed upon them, as is the case with a judicial judgement.
Binding mediation has grown in popularity as an option to arbitration in recent years because it combines the negotiation elements of mediation with the assurance of a successful resolution. Additionally, mediation is significantly less expensive than prolonged legal action or arbitration.
